Where Can Malaysians Buy Freehold Property in Southeast Asia?

 

Dreaming of owning a piece of paradise in Southeast Asia where you can pass the keys down to your kids without worrying about a lease expiring? For many Malaysians, a freehold title is the ultimate gold standard of property investment.

But if you’ve started looking across our borders, you’ve probably hit a legal brick wall. Southeast Asia has some of the strictest foreign property ownership laws on the planet. With very few exceptions, foreigners cannot directly own land freehold in this region.

However, all hope is not lost! If you pivot your focus from landed villas to high rise condominiums (strata titles), a few doors open wide. Let’s look at where you can legally secure a freehold slice of Southeast Asian real estate, and where you should absolutely watch your step.

Where the Freehold Doors Are Open

  • Thailand (Bangkok, Phuket, Chiang Mai)

    • Under the Thai Condominium Act, you can own a condo unit 100% outright in your own name and receive a Chanote (title deed) just like a local.

    • Foreigners cannot own more than 49% of the total sellable area in any given condo building. If a project is highly popular with international buyers, this quota fills up fast.

    • Your funds must originate from outside Thailand in foreign currency (like MYR or USD) and be converted by the receiving Thai bank, which issues a mandatory Foreign Exchange Transaction (FET) form. You cannot get your freehold title registered without this.

  • Cambodia (Phnom Penh, Siem Reap)

    • Thanks to the 2010 Foreign Ownership Law, Malaysians can secure a freehold “Strata Title” for condominium units in their own name. Cambodia is currently a favorite for investors seeking high rental yields.

    • You can only buy units from the first floor and above the ground floor and any underground floors must remain Cambodian owned.

    • A single building’s total foreign ownership cannot exceed 70%.

  • Singapore

    • You are legally permitted to freely buy freehold private apartments and condominiums on the open market.

    • While it is legally straightforward, Singapore deters foreign buyers with a crushing 60% Additional Buyer’s Stamp Duty (ABSD) on the purchase price. Unless you have immense capital and are looking purely for a safe-haven asset, this tax heavily eats into your initial return on investment.

  • Philippines

    • Similar to Thailand, the Philippine Condominium Act allows foreigners to hold freehold strata titles for individual apartment units.

    • Foreign ownership inside a single condominium corporation is strictly capped at 40%.

The Closed Doors & Danger Zones

  • Indonesia: Foreigners cannot buy freehold property here. The absolute maximum ownership a foreigner can hold is Hak Pakai (Right to Use) or Hak Sewa (Leasehold), which are long term leases typically capped at 30 years and extendable up to 70 or 80 years total.

  • Vietnam: Even for high-rise apartments, foreigners are strictly limited to a 50 year leasehold title, though there are occasional possibilities to extend it.

  • In places like Bali or Thailand, agents might suggest setting up a local shell company with a local proxy holding 51% of the shares so you can buy land. Governments have severely clamped down on these nominee structures. It is illegal, and if caught, the land can be confiscated, leaving you with zero legal recourse.

  • If you buy a villa in Thailand, you will likely be offered a 30 year leasehold with “guaranteed contractual renewals” up to 90 years. Be aware that only the first 30 years are legally guaranteed by the government. The subsequent renewals are merely contractual promises between you and the landlord if the landlord passes away or sells the underlying land, enforcing those renewals in court can become a nightmare.
